Judgment for Mesothelioma Claimant in Malta

by Laurie Kazan-Allen

In December 2006, Mr. Justice Philip Sciberras issued a plaintiff's verdict in the case brought by Carmena, Dorothy and James Fenech, the heirs of the late Joseph Fenech who died, aged 55, in 1997 from malignant mesothelioma. The defendant, the government-owned Malta Dry docks, was found liable for hazardous asbestos exposures experienced by Mr. Fenech during the course of his 35+ years employment which commenced in 1959. Negotiations were on-going between the parties on the size of settlement and an announcement is expected in January 2007.
